В Молдове будут улучшены и расширены возможности Бюро кредитных историй

В частности, это относится к сбору и поставке информации о задолженностях населения и экономических субъектов. Это предусматривает соответствующий законопроект, который одобрило правительство. Как отметил зампредседателя Админсовета Национальной комиссии по финансовому рынку Юрий Филип, документ оговаривает предоставление Бюро кредитных историй информации о невыполнении физическими лицами своих обязательств перед кредитными организациями без предварительного согласия физлиц. Он подчеркнул, что в настоящее время любая такая информация по физлицам может быть обработана кредитными организациями и Бюро кредитных историй только с их предварительного согласия. Вносимые поправки касаются большей части населения, и должны быть осознаны всеми, кто обращается за кредитами в банковские и внебанковские учреждения, - сказал Юрий Филип. Законопроект предусматривает улучшение законодательства, касающегося формирования, обработки, хранения и предоставления Бюро кредитных историй информации об исполнении дебиторами своих обязательств по кредитным договорам. Согласно документу, в случае с юридическими лицами и индивидуальными предпринимателями, информация в Бюро кредитных историй будет представляться без их предварительного согласия. Кроме того, планируется сократить сроки представления информации Бюро кредитных историй источниками формирования кредитной истории и сроки хранения информации. Так, оговорено, что источники формирования кредитной истории представляют информацию в Бюро кредитных историй в срок, предусмотренный договором об оказании информационных услуг, но не позднее семирабочих дней со дня совершения действия (наступления события), информация о котором входит в состав кредитной истории в соответствии с настоящим законом, либо со дня, когда источнику формирования кредитной истории стало известно или должно было стать известно о совершении такого действия (наступлении такого события). Ранее этот срок не должен был превышать 30 календарных дней. В то же время оговорено, что Бюро кредитных историй будет хранить кредитные истории в течение пяти лет со дня последнего изменения информации об обязательствах дебитора, содержащейся в кредитной истории, за исключением информации об обращении за кредитом, которая хранится в бюро кредитных историй 15 календарных дней. Ранее законом был предусмотрен 7-летний срок хранения. Его было решено сократить по предложению международных экспертов, учитывая, что семь лет - достаточно много для хранения информации, и в более чем 50% стран, где действуют Бюро кредитных историй, такая информация удаляется через пять лет. В международной практике срок от трех до пяти лет считается справедливым для создания надежной базы данных и предоставления второго шанса потребителю с негативной кредитной историей.
