Валютные операции: Упрощение правил не освобождает от ответственности

В Молдове будут упрощены правила проведения валютных операций. В «Monitorul Оficial» опубликован новый Регламент об условиях и порядке осуществления валютных операций, принятый исполнительным комитетом Национального банка 13 февраля. Он вступит в силу через 2 месяца – с 1 мая 2018 г. Документ устанавливает общие правила осуществления валютных операций посредством поставщиков (или поставщиками) платежных услуг резидентов (ПУР) - через лицензированные банки и платежные общества, общества, выпускающие электронные деньги, и поставщиков почтовых услуг. Регламент включает правила осуществления резидентами и нерезидентами через поставщиков ПУР: • платежей в рамках валютных операций; • правила получения/осуществления платежей/переводов в рамках валютных операций поставщиков ПУР; • особенности платежей/переводов в рамках валютных операций, подлежащих уведомлению/разрешению; • порядок осуществления обменных валютных операций в Молдове; • особенности документов, которые представляются резидентами и нерезидентами поставщикам ПУР в случае платежей и переводов в рамках валютных операций; • условия относительно операций с наличной иностранной валютой и с дорожными чеками в иностранной валюте в рамках валютных операций некоторых юридических лиц. Новый регламент упрощает правила осуществления валютных операций с учетом развития сектора платежных услуг и технологий в этой области, которые позволяют поставщикам ПУР использовать различные электронные, цифровые и IT-решения и обслуживать клиентов дистанционно. Так, физлица и юридические лица смогут совершать определенные безналичные денежные переводы в сумме до 10 тыс. евро без представления обосновывающих документов. Также без представления обосновывающих документов физлица смогут осуществлять операции с наличностью в пределах 10 тыс. евро, а юридические лица – до 5 тыс. евро. Поставщики ПУР должны будут владеть информацией о назначении, получателе и сумме платежа и проверять, выдаются ли денежные средств в соответствии со ст.26 Закона о валютном регулировании. Поставщики ПУР не будут запрашивать удостоверение личности, если это не предусмотрено в регламенте, но они будут вправе самостоятельно определять, на базе внутренних правил, способ представления документов для проведения платежей. В то же время, поставщики ПУР обязаны будут разработать внутренние правила, устанавливающие меры, сроки, процедуры и способы проверки на предмет соблюдения требований валютного законодательства. В Национальном банке отмечают, что упрощение правил осуществления платежей в рамках валютных операций не освобождает нерезидентов и резидентов, в том числе поставщиков ПУР, от соблюдения законодательства Молдовы в области предотвращения и борьбы с отмыванием денег и финансированием терроризма.
