Verdictul va fi dat de Consiliul Concurenței

Guvernul nu a susținut scutirea de TVA fără drept de deducere a hârtiei de la poziția tarifară 480100000 în volumul utilizat pentru publicațiile periodice de importanță socială, prevedere inclusă în inițiativa legislativă înregistrată de un grup de deputați. Potrivit autorilor, proiectul ce prevede modificarea Codului fiscal, a Legii cu privire la libertatea de exprimare, Legii comunicațiilor poștale și a Legii bugetului pentru anul 2018 are drept scop crearea condițiilor de funcționare și susținere a presei autohtone de importanță naţională. În avizul Guvernului se menționează că activitatea de editare a publicațiilor periodice, inclusiv hârtia utilizată pentru tipărirea acestora, nu constituie obiecte ale scutirii de TVA și nici ale aplicării unor cote reduse. Totodată, Guvernul consideră că textul „în volumul utilizat pentru editarea publicațiilor periodice de importanță socială” va genera dificultăți în cadrul procesului de administrare fiscală și vamală, în contextul în care regimul TVA urmează a fi aplicat de furnizor la momentul livrării hârtiei sau de organul vamal la importul acesteia, nefiind cunoscută cantitatea exactă care va fi utilizată pentru editarea publicațiilor periodice de importanță socială. Este necesar de a se revedea propunerea de acordare a scutirilor pentru anumite întreprinderi în contextul în care acest fapt ar putea avea un efect de reducere a veniturilor bugetului și ar putea crea o distorsiune concurențială, a menționat ministrul Finanțelor, Octavian Armașu. Totodată, în aviz se menționează că este indispensabil ca proiectul să fie examinat de Consiliul Concurenței, pentru a evalua compatibilitatea propunerilor cu mediul concurențial. De asemenea, autorii mai propun completarea Legii cu privire la libertatea de exprimare cu un articol ce va reglementa noţiunea de publicații periodice de importanță socială. Potrivit lor, acestea ar fi publicațiile care conțin materiale realizate în volum de 80% de redacții sau jurnaliști independenți din Republica Moldova și abordează subiecte analitice, investigații, promovează democrația și drepturile omului.
