Юридические аспекты возмещения морального ущерба по трудовым спорам
Требование о возмещении морального ущерба является распространенной практикой подачи работниками исковых заявлений против работодателей. Оспаривание решений о применении дисциплинарных взысканий, об увольнении, требования по заработной плате сопровождаются, как правило, в заключение, заявлением о понесенном моральном ущербе. Подтверждение наличия ущерба как такового за значительный период времени, а также сама приемлемость заявления о возмещении морального ущерба были и остаются спорными вопросами. В лит. к) ст. 5 Трудового кодекса (далее – Кодекс) в числе основных принципов регулирования трудовых отношений и иных непосредственно связанных с ними отношений предусмотрен принцип «обязательности полного возмещения работодателем материального и морального ущерба, причиненного работнику в связи с исполнением им трудовых обязанностей».
