SFS: cum să ne protejăm de pseudo-inspectori

Serviciul Fiscal de Stat vine cu o serie de precizări menite să prevină cazurile de escrocherie din partea persoanelor care s-ar putea prezenta drept inspectori fiscali și ar întreprinde tentative ilegale de verificare a agenților economici pentru a obține beneficii financiare. Astfel, menționăm că, la iniţierea controlului fiscal la faţa locului sau la inițierea procesului de constatare a faptei contravenționale, funcţionarul este obligat să prezinte contribuabilului Decizia de iniţiere a controlului, în baza căreia sunt efectuate controalele respective, şi legitimația de serviciu. Decizia privind iniţierea controlului se întocmește și în cadrul inițierii procesului de constatare a faptei contravenționale. Modelul acestui act îl puteți vedea aici. Totodată, contribuabilul supus verificărilor este în drept să solicite inspectorului fiscal să se legitimeze. Legitimația reprezintă un document oficial care adevereşte statutul juridic al funcționarului fiscal şi confirmă împuternicirile acestuia în exercitarea atribuțiilor. Excepţie este efectuarea cumpărăturii de control, exprimată în crearea artificială de către funcţionarul fiscal a situaţiei de procurare a bunurilor materiale, de efectuare a comenzii de executare a lucrărilor sau de prestare a serviciilor fără scopul de a le achiziţiona (consuma) sau de a le comercializa. După efectuarea acesteia, contribuabilul este informat despre aplicarea procedurii corespunzătoare, iar funcționarul fiscal este obligat să prezinte contribuabilului Decizia de iniţiere a controlului şi legitimaţia de serviciu. După constatarea cauzei, bunurile materiale se restituie contribuabilului, iar mijloacele băneşti – funcţionarului împuternicit. Concomitent, la finalizarea controlului fiscal la faţa locului, inspectorul fiscal întocmeşte un act de control fiscal în conformitate cu prevederile Codului fiscal. În actul de control fiscal se consemnează rezultatele controlului, specificându-se încălcările depistate. Acest act este semnat de ambele părți participante la control, iar un exemplar este prezentat agentului economic supus verificării. În cadrul procesul de constatare a faptei contravenționale, la depistarea acesteia se întocmește procesul-verbal cu privire la contravenție. ATENȚIE! În cazul în care contribuabilul supus verificării are dubii cu privire la legalitatea controlului sau identitatea persoanei ce se prezintă a fi funcționar fiscal, Serviciul Fiscal de Stat solicită insistent să fie sesizat la numărul de telefon 0 8000 1525, linia fierbinte, tasta 4, Centrul Unic de Apel al Serviciului Fiscal de Stat, sau 0 22 82 34 06, 0 684 33 990, Direcția Securitate Internă și Anticorupție a SFS. Stimați contribuabili, SFS recomandă să țineți cont de cele expuse supra pentru a fi în siguranță.
