SFS: exagerarea adaosului comercial este inadmisibilă

Serviciul Fiscal de Stat continuă verificările la contribuabilii ce practică activitatea de comerț cu amănuntul al produselor farmaceutice și comerț cu amănuntul/ridicata al mărfurilor social importante. Astfel, în perioada 1 – 7 aprilie 2020, au fost efectuate 114 controale fiscale, în rezultatul cărora au fost stabilite 25 cazuri de încălcare a prevederilor Hotărârii Guvernului nr.774 din 26 iunie 2016 cu privire la prețurile de comercializare a produselor social importante, fiind stabilite majorări a adaosului comercial cu o depășire de la 1,99 % până la 12,38 % pentru produsele alimentare (pâine, lapte, hrișcă, orez, făină de grâu, fulgi de ovăz) și cu o depășire de la 13,55 % până la 25 % la produsele farmaceutice (dezinfectanți). Zilnic, SFS monitorizează activitatea a 812 farmacii sub aspectul prețurilor de livrare a produselor social importante (măști medicinale, mănuși medicinale, dezinfectanți medicali) și adaosul comercial aplicat, în vederea respectării prevederilor legislației în vigoare. Suplimentar, a fost efectuat un control fiscal prin metoda verificării tematice la un contribuabil care în lanțul de intermediere în comerțul cu produse social-importante (măști medicinale) a admis încălcarea modului de formare a prețului de comercializare prin exagerarea adaosului comercial, ca rezultat fiind obținut un venit ilicit în mărime de 40 mii lei. Agentul economic care a admis încălcări în partea ce ține de formarea prețurilor la mărfruile social importante poartă răspundere în conformitate cu prevederile Legii nr. 845 din 03 ianuarie 1992 cu privire la antreprenoriat și întreprinderi. Potrivit acesteia, veniturile ilicite obţinute de agenţii economici prin exagerarea adaosului comercial, precum şi amenzile aplicate în cuantum echivalent acestor venituri, se percep la bugetul de stat. Serviciul Fiscal de Stat atenționează că, săptămânal, vor fi desfășurate acțiuni de verificare a respectării prețurilor la produsele social importante, lista cărora se regăsește în anexa la Regulamentul de formare a preţurilor de comercializare a produselor social importante aprobat prin HG nr.774.
