Taxa pentru poluarea mediului - nouă taxă administrată de Serviciul Fiscal de Stat

Începând cu data de 1 ianuarie 2017, taxa pentru poluarea mediului este administrată de Serviciul Fiscal de Stat. Până în prezent, aceasta s-a aflat în gestiunea Serviciului Vamal. Transmiterea atribuției de administrare a fost efectuată în baza Legii cu privire la modificarea și completarea unor acte legislative (nr. 281 din 16 decembrie 2016). Taxa pentru poluarea mediului (ecologică) urmează a fi achitată de către persoanele juridice ( indiferent de tipul de proprietate și forma juridică de organizare) și de către persoanele fizice care desfășoară activitate de întreprinzător și care produc, importă și/sau procură de la agenții economici de pe teritoriul Republicii Moldova, care nu au relații fiscale cu sistemul ei bugetar, mărfuri (indicate în anexa nr.8 la Legea sus menționată), sau produse în ambalaj din materiale plastice (specificat la pozițiile tarifare 3923 21, 3923 29 și 3923 30), sau în ambalaj din carton neondulat (specificat la poziția tarifară 4819 20 000), cu sau fără folie de aluminiu și/sau polietilenă. Obiectele ce urmează a fi taxate sunt cele care în procesul utilizării cauzează poluarea mediului, emit poluanți și pot fi depozitate ca deșeuri de producție. Odată cu trecerea în administrarea SFS, acest tip de taxă nu a fost modificat. Astfel, taxa ecologică cuprinde aceleași tipuri de plăți:
  1. Plata pentru emisiile de poluanți ale surselor staționare
  2. Plata pentru deversările de poluanți
  3. Plata pentru depozitarea deșeurilor de producție
  4. Plata pentru mărfurile care în procesul utilizării cauzează poluarea mediului.
Cotele pentru calcularea taxei respective sunt stabilite în dependență de tipul de marfă și produse, tipul ambalajului, cât și de capacitatea lor. Astfel, începând cu 1 ianuarie 2017, agenții economici, plătitori ai taxei ecologice, au posibilitatea să beneficieze de un răgaz de timp la achitare. Termenul de plată a fost modificat până la data de 25 a lunii următoare după luna gestionară, față de data importului cum era prevăzut anterior. Totodată, este necesar de reținut: odată cu transmiterea taxei ecologice în administrarea Fiscului, plătitorii au obligația de a prezenta SFS declarațiile corespunzătoare, lunar, până la data de 25 a lunii următoare lunii de gestiune. Persoanele cointeresate pot consulta Legea privind plata pentru poluarea mediului (nr.1540-XIII din 25 februarie 1998). În același timp, SFS informează că Baza generalizată a practicii fiscale este completată cu un nou capitol: ,,Taxa pentru poluarea mediului”.
