Биткоины для целей налогообложения считаются собственностью – IRS (США)

Американские налоговики (Internal Revenue Service – IRS) выпустили вчера информационное письмо, в котором сообщили, что с точки зрения налогообложения будут считать биткоины и прочие виртуальные валюты в качестве собственности, а все транзакции с ними – как транзакции с собственностью. По биткоинам американским налоговикам в последнее время приходит очень много вопросов, а подобные информационные сообщения как раз и предназначены для того, чтобы быстро дать ответы на самые злободневные вопросы. Конечно, виртуальные валюты в последние годы приобрели невиданную ранее популярность, но при этом восприятие их стало несколько неоднозначным. Связать это можно в том числе и с коллапсом популярных виртуальных бирж, таких как Mt. Gosk и Vicurex. Произошло это в результате серии хакерских атак, приведших к исчезновению сотен миллионов долларов. Кроме того, многие еще помнят очень некрасивый скандал с отмыванием, в результате которого арестовали вице-президента Bitcoin Foundation Чарли Шрема, а главная площадка, использовавшаяся для совершения нелегальных операций – сайт Silk Road – был закрыт (см. http://gaap.ru/news/138746). Письмо IRS свидетельствует о том, американские налоговые службы все же пытаются рассматривать виртуальные валюты в качестве объекта для налогообложения и дают налогоплательщикам представление о том, как будут осуществляться отчисления. В самом деле, почему бы и нет? В некоторых юрисдикциях виртуальные валюты играют практически ту же роль, что и реальные деньги (купюры, монеты и т.д.). При этом IRS признает, что юридический статус у них все же разный. Впрочем, это не помешает биткоинам стать – хотя бы в представлении федеральных налоговых служб – объектом налогообложения. Например, если заработные платы выплачиваются сотрудникам в виртуальных валютах, налог на них будет отчисляться точно так же, как если бы они получали на свой счет обычные доллары.
