Românii care încheie contracte cu parteneri străini trebuie să declare aceste documente la Fisc

Documentele încheiate de persoane juridice sau fizice române cu persoane juridice străine sau persoane fizice nerezidente se înregistrează la organul fiscal competent, se precizează într-un comunicat al Agenţiei Naţionale de Administrare Fiscală (ANAF). Persoanele juridice române şi persoanele fizice rezidente au obligaţia să înregistreze contractele/documentele încheiate cu persoane juridice străine sau persoane fizice nerezidente care execută pe teritoriul României prestări de servicii de natura lucrărilor de construcţii, de montaj, activităţilor de supraveghere, activităţilor de consultanţă, de asistenţă tehnică şi a oricăror altor servicii prestate în România, care generează venituri impozabile, conform art. 8, alin. (8) din Codul Fiscal, precizează ANAF. De asemenea, aceeaşi obligaţie o au şi persoanele juridice străine care desfăşoară activitate în România printr-un sediu permanent/sediu permanent desemnat. Înregistrarea documentelor menţionate, indiferent de durata lor, se efectuează la organul fiscal competent, prin depunerea Declaraţiei 017. Contribuabilii mari şi mijlocii fac excepţie şi au obligaţia înregistrării documentelor la organul fiscal central competent pentru administrare. În acest sens, arată ANAF, s-a întocmit Proiectul de Ordin al Preşedintelui Agenţiei Naţionale de Administrare Fiscală privind procedura de înregistrare a contractelor/documentelor încheiate între persoane juridice române, persoane fizice rezidente, precum şi persoane juridice străine care desfăşoară activitate în România printr-un sediu permanent/sediu permanent desemnat, şi persoane juridice străine sau persoane fizice nerezidente.
