Предложение подвергать пожизненной дисквалификации аудиторов обанкротившихся банков (также страховых компаний и НПФ) озвучили в Совете Федерации РФ. Речь идет о тех, кто подписывает отчетность, подтверждая стабильное финансовое состояние банка, тогда как на самом деле у него могут быть серьезные проблемы, приводящие со временем к отзыву лицензии. Речь идет о законопроекте по теме деловой репутации, который уже был принят в первом чтении. Изначально он оговаривал возможность дисквалификации топ-менеджеров обанкротившихся организаций сроком до 10 лет. Сегодня Совфед совместно с Минфином России предлагает ужесточение, которое, впрочем, может оказаться не насколько страшным, учитывая возможность подачи апелляции в ЦБ для отмены решения. Кстати, дисквалификация до 10 лет для высшего руководства компаний уже не видится Минфину такой эффективной, ведь топ-менеджеры, разумно предположить, в курсе происходящих в компании процессов – следовательно, если они в курсе трудностей, и компания все равно приходит к банкротству, то это либо чистая халатность с их стороны, либо сознательное доведение до банкротства. Таким образом, сегодня говорят уже о пожизненной дисквалификации для генерального директора (либо председателя правления в случае банковской организации), его или ее замов, бухгалтера и членов наблюдательного совета. Совфед предлагает расширить этот список и на аудиторов и руководителей рейтинговых агентств. Минфин России готов поддержать обсуждавшиеся Советом Федерации предложения, но хочет оставить возможность оспорить решение в ходе апелляции в ЦБ. Нельзя сказать, что участники рынка категорически против ужесточения. На самом деле, сознательное доведение до банкротства должно караться адекватно, однако во всех случаях необходимо еще доказать это через суд.
