1. (10.4.19) Dacă perioada de activitate solicitată a fi desfășurată în baza patentei de întreprinzător constituie o lună, dar cuprinde două luni calendaristice, pentru cîte luni urmează a fi achitate taxa pentru patenta și contribuțiile de asigurări socia

Conform art. 4 alin. (5) din Legea cu privire la patenta de întreprinzător nr. 93-XIV din 15.07.1998, la cererea de eliberare sau de prelungire a patentei se anexează documentele confirmative de achitare a contribuţiei de asigurare socială de stat pentru întreaga perioadă solicitată de desfăşurare a activităţii în baza patentei de întreprinzător sau actele care confirmă scutirea de plata contribuţiei, precum şi documentele ce confirmă statutul de persoană asigurată în sistemul asigurării obligatorii de asistenţă medicală. În conformitate cu Legea privind sistemul public de asigurări sociale nr. 489-XIV din 08.07.1999, persoana asigurată este persoana fizică aptă pentru muncă, cu domiciliul sau reşedinţa în Republica Moldova, avînd obligaţia de a plăti contribuţii de asigurări sociale în vederea beneficierii de dreptul pentru prevenirea, limitarea sau înlăturarea riscurilor sociale prevăzute de lege. Categoriile de plătitori și persoane asigurate, tarifele și termenele de achitare a contribuțiilor de asigurări sociale obligatorii de stat sunt reflectate în Anexa nr. 1 la legea menționată. Potrivit pct. 1.8. din această Anexă, titularii patentei de întreprinzător (cu excepţia pensionarilor, persoanelor cu dizabilităţi) achită contribuţia de asigurare socială de stat în conformitate cu legea bugetului asigurărilor sociale de stat anuală, dar nu mai puţin de 1/12 din această sumă lunar, în funcţie de durata activităţii desfăşurate pe bază de patentă. Astfel, în cazul în care perioada de activitate solicitată a fi desfășurată în baza patentei de întreprinzător constituie o lună, dar cuprinde două luni calendaristice, taxa pentru patentă se achită pentru o lună, iar contribuțiile obligatorii de asigurări sociale de stat - pentru două luni, în mărime de 1/12 lunar din suma fixă anuală, stabilită de legea privind bugetul asigurărilor sociale de stat.
