2. (29.1.6.2.24) Este obligat beneficiarul de lucrări din agricultură să completeze și să prezinte Informația privind stabilirea drepturilor sociale şi medicale aferente raporturilor de muncă (Forma IRM19) pentru lucrătorii zilieri ?

Informaţia privind stabilirea drepturilor sociale şi medicale aferente raporturilor de muncă (Forma IRM19) se completează în corespundere cu ordinele întocmite de către angajator pentru următoarele situaţii ce ţin de raporturile de muncă: a) în cazul angajării sau modificării/încetării raporturilor de muncă; b) aflare a persoanei în perioada unui risc asigurat (îngrijire a copilului până la 3 ani, îngrijire a copilului de la 3 la 4 ani, concediul paternal); c) stabilire a unei funcţii care acordă dreptul la pensie în condiţii speciale. În cazul dat nu se întocmeşte ordinul de către angajator, pct. 3 din Instrucţiune cu privire la modul de completare a Informaţiei privind stabilirea drepturilor sociale şi medicale aferente raporturilor de muncă (Forma IRM19), anexa nr.4 la Ordinul Ministerului Finanţelor nr.126 din 4 octombrie 2017. Totodată, în conformitate cu art. 4 alin. (1) din Legea privind exercitarea unor activităţi necalificate cu caracter ocazional desfăşurate de zilieri nr. 22/2018 raportul dintre zilier şi beneficiar se stabileşte în condiţiile prevăzute la art.1 din Legea menționată, prin acordul de voinţă al părţilor, fără încheierea în formă scrisă a unui contract individual de muncă. Respectiv, deoarece raporturile de muncă nu se stabilesc prin contractul individual de muncă, dar prin acordul de voinţă al părţilor, beneficiarul de lucrări din agricultură nu va fi obligat să completeze și să prezinte Informaţia privind stabilirea drepturilor sociale şi medicale aferente raporturilor de muncă (Forma IRM19).
