2. (35.1.17) La imprimarea de sine stătător a formularelor facturii fiscale este obligatorie imprimarea tabelei prevăzute pe versoul formularului (rândurile 18–22)?

În conformitate cu art.11 alin.(7) din Legea contabilității și raportării financiare nr. 287 din 15.12.2017, documentele primare întocmite conțin elemente obligatorii prestabilite. Pentru factura fiscală aceste elemente sunt specificate la art.117 alin.(2) din Codul fiscal. Totodată, pct.10 din Instrucţiunea privind completarea facturii fiscale, aprobată prin Ordinul ministrului finanţelor nr.118 din 28 august 2017 (în vigoare din 28.10.2017), prevede că, dacă, pornind de la specificul livrării nu apare necesitatea completării în factura fiscală a unor indicatori, cu excepţia celor obligatorii, aceştia nu se completează. Concomitent, prin Ordinul ministrului finanţelor nr.143 din 23 noiembrie 2017 (Monitorul Oficial al Republicii Moldova, 2017, nr.434-439, art.2240) pct.10 al Instrucţiunii privind completarea facturii fiscal a fost completat cu prevederea, conform căreia tabelul de pe versoul formularului facturii fiscale ce cuprinde rândurile 18–22 nu se imprimă în cazul lipsei indicatorilor respectivi. [Modificare în Baza generalizată a practicii fiscale în temeiul Legii contabilității și raportării financiare nr. 287 din 15.12.2017, în vigoare 01.01.2019].
