(28.27.14) Angajatul unei companii din RM, din contul său personal în cadrul unei rețele de socializare a contractat și achitat servicii de publicitate a activității angajatorului. Cine în situația respectivă urmează să achite TVA aferent acestei prestări

Potrivit prevederilor art.95 alin.(11) din Codul fiscal, serviciile prestate prin rețelele informaționale de telecomunicații, inclusiv prin rețeaua internet, în mod automatizat, cu utilizarea tehnologiilor informaționale prestate de către nerezident care desfășoară activitate de întreprinzător fără deținerea formei organizatorico-juridice în Republica Moldova constituie obiect al impunerii în cadrul „e-Commerce VAT”.  

        Potrivit prevederilor art.111 alin.(5) din Codul fiscal, locul livrării serviciilor prevăzute la art.95 alin.(11), prestate de către nerezidenții care desfășoară activitate de întreprinzător fără deținerea formei organizatorico-juridice în Republica Moldova pentru persoanele fizice rezidente ale Republicii Moldova care nu desfășoară activitate de întreprinzător, se consideră Republica Moldova dacă este îndeplinită cel puțin una dintre următoarele condiții:  

           a) reședința persoanei fizice este în Republica Moldova; 

      b) sediul instituției financiare în care este deschis contul utilizat pentru achitarea serviciilor sau sediul operatorului de mijloace financiare electronice, prin intermediul căruia are loc achitarea, este în Republica Moldova; 

        c) adresa în rețea (IP) a dispozitivului utilizat de către cumpărător pentru procurarea serviciilor este în Republica Moldova;

          d) prefixul telefonic de tara utilizat pentru procurarea sau achitarea serviciilor este atribuit Republicii Moldova.

         Prin urmare, reieșind din faptul că în cadrul situației expuse serviciile au fost contractate de către o persoană fizică, obligația aferentă TVA în cadrul acestei tranzacții urmează a fi onorată de către agentul economic nerezident prestator de servicii.
