4. (29.1.4.12) Poate beneficia contribuabilul de scutirea personală a soţului/soţie dacă după încheierea anului fiscal, în care fiecare a beneficiat de scutirea sa personală, ei au decis ca scutirea soţului/soţiei să o transmită contribuabilului?

Conform art. 34 alin. (1) și (2) din Codul fiscal, persoana fizică rezidentă aflată în relaţii de căsătorie are dreptul la o scutire suplimentară în mărimea prevăzută la art. 33, cu condiţia că soţia (soţul) nu beneficiază de scutire personală. Prin urmare, ținînd cont de prevederile pct. 17 din Regulamentul cu privire la determinarea obligaţiilor fiscale aferente impozitului pe venit al persoanelor fizice care nu practică activitate de întreprinzător (anexa nr.2) aprobat prin Hotărîrea Guvernului nr. 77 din 30 ianuarie 2008, în cazul în care contribuabilul şi soţia (soţul) acestuia au beneficiat pe parcursul perioadei declarate fiecare de scutirea sa personală, iar conform rezultatelor anului fiscal au decis că soţia (soţul) se dezice de scutirea personală, contribuabilul are dreptul la scutirea acordată soţiei (soţului), cu condiţia că soţia (soţul) prezintă Declarația persoanei fizice cu privire la impozitul pe venit în care se dezice de scutirea sa personală care i-a fost acordată pe parcursul perioadei declarate cu recalcularea obligaţiei privind impozitul pe venit.
