42. (4.1.4) Dacă încăperile în care au loc producerea și/sau prelucrarea mărfurilor supuse accizelor, nu aparțin antrepozitarului autorizat cu titlu de proprietate, dar sunt luate în arendă sau în locațiune, constituie acestea părți componente a antrepozi

Antrepozitarul autorizat (locatar) care arendează o încăpere de la un alt antrepozitar autorizat (locator), dispunând de contract de arendă sau de închiriere în condițiile acțiunii art.126 din Codul fiscal, urmează să prezinte Serviciului Fiscal de Stat cererea de solicitare a efectuării modificărilor în certificatul de acciză, în care declară antrepozitul fiscal, adresa acestuia, proprietarul încăperii arendate (denumirea, codul fiscal, adresa juridică, telefonul) si termenul de valabilitate a contractului de arendă sau de închiriere. Concomitent, agentul economic respectiv, urmează să prezinte schema (planul) amplasării locului arendat si aduce spre cunoștință formele si metodele concrete de control, a căror aplicare asigură integritatea mărfurilor supuse accizelor, inclusiv la expedierea lor dintr-un antrepozit fiscal în altul ale unuia și aceluiași agent economic, dacă aceste antrepozite se află pe teritorii diferite. [Modificare în Baza generalizată a practicii fiscale în temeiul Legii pentru modificarea şi completarea unor acte legislative nr.288 din 15.12.2017, în vigoare de la data 01.01.2018].
