Об утере налоговой накладной
Выписанная налоговая накладная на сумму поставки свыше 100 тыс. леев была зарегистрирована в ГЭРНН. В связи с утерей всех экземпляров, объявление об утере данной накладной опубликовано в Мониторул Офичиал. Какие штрафные санкции понесут стороны (поставщик и покупатель)? В соответствии с положениями ст.43 ч.(6) Закона о бухгалтерском учете №113-XVI от 27.04.2007г., в случае утери, изъятия или уничтожения бухгалтерских документов, руководитель субъекта обязан их восстановить в течение двух месяцев со дня обнаружения данного факта. В случае утери всех экземпляров налоговой накладной и невозможности ее восстановления, экономический агент должен выписать другую налоговую накладную, в которой будет указана фактическая дата поставки (дата поставки, указанная в утерянной налоговой накладной), фактическая дата выдачи (дата выдачи новой налоговой накладной) и будет сделана запись „În locul facturii fiscale pierdute seria ___nr._____ din ___._____.____".
