Conform art. 37 alin. (1) din Legea insolvabilității nr. 149/2012, hotărârea de intentare a procedurii de insolvabilitate poate fi atacată cu recurs de către debitor, cu excepția cazului prevăzut la art. 21 alin. (6) sau de către orice creditor care are un interes legitim.

Определением Экономической апелляционной палаты было допущено к рассмотрению исковое заявление АО «X», а Решением Экономической апелляционной палаты был возбужден процесс несостоятельности в отношении должника АО «X», с установлением процедуры банкротства. Решением собрания кредиторов должника было решено избрать комитет кредиторов АО «X» и назначить его членов.
Решением Экономической апелляционной палаты был возбужден процесс несостоятельности в отношении должника АО «X». В рамках процесса несостоятельности, участники процесса прибегли к предъявлению требований, на основании ст. 140 Закона № 149/2012 о несостоятельности. Субъектом – кредитором был упущен срок утверждения требований и судебным решением ему было отказано в признании/утверждении требований.
Отсутствие упоминания «Обратное налогообложение» в соответствующей графе не освобождает субъектов налогообложения, указанных в п. е) и п. f) ст. 94 НК, от обязательства оплаты НДС в бюджет относительно соответствующей закупки.

Întreprinderea X, aflată în procedură de insolvabilitate, a livrat numele comercial către întreprinderea Y și a emis factura fiscală. Numele comercial al întreprinderii X nu este înregistrat drept proprietatea intelectuală. Este livrarea descrisă împozabilă cu TVA? Care este procedura de calculare și achitare a obligației fiscale?

SRL X обратилась в Государственную налоговую службу (ГНС) для возмещения ошибочно перечисленной суммы на текущие счета ликвидатора. Возникает вопрос: можно ли произвести возмещение ошибочно уплаченной суммы (код ЕСО 111230) на банковский счет ликвидатора?
