Serviciile în cauză sunt scutite de TVA fără drept de deducere potrivit prevederilor art. 103 (1) pct. 12) din Codul fiscal.
Potrivit prevederilor art. 103 alin. (1) pct. 12) lit. d) din Codul fiscal, sunt scutite de TVA fără drept de deducere operaţiile legate de emiterea actiunilor, obligaţiunilor, cambiilor şi altor valori mobiliare, inclusiv operaţiile comerciale şi de intermediere pe piaţa valorilor mobiliare, operaţiile registratorilor independenţi

Codul Civil stipulează că prin contract de factoring, o parte, care este furnizorul de bunuri și servicii (aderent), se obligă să cedeze celeilalte părți, care este o întreprindere de factoring (factor), creanțele apărute sau care vor apărea în viitor din contracte de vînzări de bunuri, prestări de servicii și efectuare de lucrări către terți, iar factorul își asumă cel puțin 2 condiții stipulate la alin. 1 art.1290 din actul menționat mai sus.
