Regimul fiscal privind aplicarea TVA se determină în dependenţă de locul prestării serviciului, stabilit în conformitate cu art.111 din Codul fiscal
În conformitate cu alineatul (1) al art. 107 din Codul fiscal transmiterea mărfurilor de către comitent comisionarului şi invers
Arhivă: Livrările scutite de TVA sunt enumerate la art. 103 din Codul fiscal. În cazul în care, acestea vor fi destinate pentru export
Potrivit prevederilor art. 102 alin. (15) din Codul fiscal şi pct. 32 alin. 2) lit. a) din Regulamentul privind restituirea taxei pe valoarea adăugată
În conformitate cu prevederile art. 104 lit. a) din Codul fiscal, mărfurile pentru export se scutesc de TVA cu drept de deducere.
Livrările de mărfuri în magazinele duty-free se scutesc de TVA cu drept de deducere (art.104 lit.h) din Codul fiscal). Se scutesc de TVA fără drept de deducere mărfurile introduse pe teritoriul vamal şi plasate sub regim vamal antrepozit vamal (art.103 alin.(2) lit.a) din CF)
Conform art.35 din Codul vamal nr.1149-XIV din 20.07.2000, în cazul în care mărfurile sînt puse în liberă circulaţie cu acordarea de facilităţi fiscale şi vamale pe motivul destinaţiei lor finale, acestea rămîn sub supraveghere vamală.
