este un certificat de stat nominativ, ce atesta dreptul de a desfăşura genul de activitate de întreprinzător indicat în ea în decursul unei anumite perioade de timp.
(art. 1 alin. (1) al Legii cu privire la patenta de întreprinzător nr. 93-XIV din 15.07.1998).

Peste 4000 de comercianți cu amănuntul vor trece într-o săptămână la o nouă formă de antreprenoriat – activitatea independentă – ca urmare a intrării în vigoare a unor modificări legislative. Tranziția este obligatorie pentru deținătorii de patente care comercializează produse la tarabe, tejghele, tonete, în chioșcuri (gherete), pavilioane sau autovehicule.

Начиная с 21 июня 2023 года лица, желающие работать в качестве специалиста по уходу за детьми, смогут оформить предпринимательский патент – именное государственное свидетельство, удостоверяющее право на занятие указанным в нем видом предпринимательской деятельности в течение определенного срока, при условии, их соответствия правовым и квалификационным требованиям, необходимым для занятия данной профессией

iconАльтернатива розничной торговли, осуществляемой на основе предпринимательского патента

Розничная торговля на основе предпринимательского патента разрешается осуществлять, согласно законодательству, до 1 июля 2023 года только патентообладателям, имеющим патенты на соответствующий вид деятельности (позиции 1.1 и 1.2 из приложения к Закону № 93/1998) непрерывно, начиная с 27 декабря 2016 года и до 31 декабря 2022 года включительно. Таким образом, 1 июля 2023 года является последним днем, кода вышеуказанные лица могут практиковать розничную торговлю на основе предпринимательского патента.

Trecerea de la patentă la activitatea independentă: Guvernul ar putea compensa unele cheltuieli

Guvernul este în drept să compenseze unele cheltuieli suportate de persoanele fizice care desfășoară activități independente și care, la data de 31 decembrie 2022, erau titulare de patentă pentru desfășurarea comerțului cu amănuntul. Structura cheltuielilor, modalitatea și perioada acordării compensațiilor urmează a fi aprobate de către Guvern.

Cum treci de la patentă la activitate independentă?

Din 1 iulie 2023 activitatea în bază de patentă urmează a fi înlocuită cu un regim fiscal simplificat – activitatea independentă. Astfel, toți cei care fac comerț cu amănuntul în piețe sau unități comerciale au obligativitatea de a trece la acest regim fiscal. Pentru a simplifica procesul de tranziție Ministerul Dezvoltării Economice și Digitalizării a identificat mai multe soluții care să le permită comercianților să-și continue activitatea.
