Conform prevederilor art. 2 din Legea nr. 113/2010 privind executorii judecătorești, executorul judecătoresc este persoană fizică învestită de stat cu competenţa de a îndeplini activităţi de interes public. Doar executorul judecătoresc licenţiat şi învestit în condiţiile legii poate efectua executarea silită. Activitatea executorului judecătoresc nu este activitate economică şi nici de întreprinzător.
