Inițial este de menționat că prin Legea nr. 278 din 16 decembrie 2016 au fost efectuate unele modificări și completări la Legea cu privire la patenta de întreprinzător nr. 93 din 15 iulie 1998 (MO, 2016, nr. 472-477) (în continuare – Lege), în același timp, prin Legea cu privire la modificarea și completarea unor acte legislative nr. 281 din 16 decembrie 2016 (în vigoare din 01.01.2017) prevederile Codului fiscal au fost completate cu o noțiune nouă „activitate independenta”, iar regimul fiscal aferent acestuia a fost stipulat în Capitolul 102 din Codul fiscal.
